MAPLETON -- A U.S. Supreme Court case decided Monday doesn't affect the city's $100 million lawsuit against Ensign-Bickford, city attorney Douglas Thayer said.
The court ruled 7-2 against a company that in 1981 bought land in Texas that had been used for aircraft engine maintenance businesses. It spent $5 million cleaning up the site, then sued to recover some of that expense using the Superfund law. However, the justices said the use the Superfund law was improper because the government had not demanded that the cleanup be done.See the full content of this document
